2.1.to present entirely correct personal information when registering as the user, including registering under the correct and entire name, and to use a valid postal address and e-mail address;
2.2.to inform haamer.net by e-mail immediately about all details that have changed compared to those presented when registering as the user of the Webpage;
2.3.to follow the procedural rules of the auction during the duration of the auction;
2.4.to keep the username and the password fixed for using the Webpage in such a way as to prevent them from being obtained by third persons, except for the case when the Customer has empowered such third persons to represent him or her when participating in the auction;
2.5.in case if the username and the password fixed for using the Webpage have been obtained by third persons, to be responsible for performing the binding obligations taken for the Customer by such persons;
2.6.not to use the Webpage for unlawful transaction(s) and/or fraud(s).
3.1.to restrict or cancel the rights of the Customer to use the Webpage if:
3.1.1.the Customer has presented incorrect, misleading and/or inaccurate information when registering as the user of the Webpage;
3.1.2.the Customer repeatedly breaks the terms and conditions or the obligations of the Customer based upon the Terms and Conditions.
3.2.to monitor actions taking place in the Webpage and to make research with respect to all alleged violations, using for this purpose all legal means.
4.1.Haamer.net shall gather personal information in accordance with the Code of Enforcement Procedure.
4.1.1.Saving the names, personal codes of the Customers and their places of residence or location, recording them in the corresponding register, which is an integral part of the auction statement.
4.2.The information mentioned in the article 4.1.1 shall be handed over to the bailiff.
5.1.The Bidder shall be registered as the user of haamer.net environment and identified via a bank link.
5.2.The Purchaser shall participate in the auction in his or her own name. The user, who has registered in the auction and paid the deposit, shall be given a unique username for participating in the auction.
5.3.It is possible to participate in the auction via a representative. The representative shall have a valid power of attorney in case the bid is declared best and immediately present it to the bailiff on the date when the bid was declared best. The principal and the empowered person shall have the obligation to prove the right of representation. The bailiff or a person, who was present as an impartial observer upon arresting the property, also a person, who organises the auction or who is an impartial observer upon carrying out the auction, and the person acting at the expense of such person shall not participate in the auction personally or via a representative (article 87 of the Code of Enforcement Procedure).
6.1.A person who wishes to participate in an auction shall pay a deposit in the amount of till ten percent of the starting price. Deposit shall be paid to the account specified by the bailiff minimum one day before the date of the auction. The user shall be enabled of participating in the auction only after the deposit has been received.
6.2.The deposit need not be paid by the state, a local government, the Bank of Estonia, the claimant and the holder of the pledge, if their claim covers the amount of the required deposit. If a person has paid the deposit, but does not participate in the auction, does not bid or is not declared the best bidder, the deposit shall be refunded. The deposit paid by the purchaser shall be included in the purchase price. The deposit shall be refunded to the other participants of the auction on the next working day following the date of the auction. (article 83 of the Code of Enforcement Procedure).
7.1.The auction shall end at the time specified in the advertisement regarding the auction. The winner of the auction shall be a person, who has offered the highest bid (article 881 of the Code of Enforcement Procedure).
7.2. The winner of an electronic auction shall pay the purchase price on the next working day following the date of the end of the auction in the manner specified in part 3 of this article. If the purchase price exceeds 12,700 euros, 1/10 of the purchase price shall be paid on the next working day following the date of the auction and the rest amount shall be paid within 15 days. If the purchaser is a debtor, the entire purchase price shall be paid on the next working day following the auction (part 21 of article 93 of the Code of Enforcement Procedure).
7.3.If the purchaser is a claimant, whose claim exceeds the purchase price or equals to it, a set-off shall be made against the claim in the amount, which corresponds to the part, which the claimant would have the right to receive upon distributing the revenue received from the sale of property, which he or she is purchasing. The claimant shall pay the amount of the purchase price, which remained unset-off, to the official account of the bailiff in the manner specified in this article.
7.4.If the purchaser, who has won the auction, violates the obligation to pay the purchase price, the item shall be immediately submitted to a repeated auction with the same starting price. The initial purchaser shall not be allowed to participate in this repeated auction. The deposit paid by him or her shall not be refunded and it shall be transferred to the budget section of the official council of the bailiffs of the chamber. He or she shall also pay the difference between the price offered by him or her and the price offered at the repeated auction, if the price offered at the repeated auction is lower than the price offered by him or her (article 100 of the Code of Enforcement Procedure).
8.Presenting Objections
8.1.Persons participating in the electronic auction may present objections to the bailiff with respect to carrying out the auctions during the next working day following the date of the end of the auction. In case of not presenting any objections they shall have no right to claim against the incorrect preparation of the report, incorrectness of the report nor to base themselves on the violation of the material conditions of the auction later (article 921 of the Code of Enforcement Procedure).
9.1.An invalid bid shall be rejected by the bailiff. An invalid bid shall be considered, first of all, the bid, which does not cover the starting price; or the bid of such person, who is not allowed to participate in the auction; or contingent bid. The bailiff may reject the bid made with the intention to fail the auction.
9.2.If the validity of the bid depends upon the extent of the right of representation of the person representing the bidder or upon the consent of another person, the bid shall be rejected by the bailiff unless the right of representation or consent is proved immediately (article 89 of the Code of Enforcement Procedure).
9.3.In case of selling a thing, except for real estate, in enforcement proceedings, the risk of accidental loss of a thing sold shall be passed to the purchaser at the time of the delivery of the thing. Starting from the delivery the purchaser shall cover all expenses and charges related to the thing and receive all benefits.
9.4.The risk of loss of the real estate and the items sold together with it shall be passed to the participant of the auction upon declaring the bid to be the best. Starting from declaring the bid to be the best the purchaser shall cover all expenses and charges and receive all benefits. The right of ownership to the real estate sold in the auction shall be created by making a record in the land register on the basis of the auction statement.
9.5.The purchaser may terminate the lease contract or rental contract on the conditions and within the deadline specified in the article 323 of the Law of Obligations Act. The purchaser may not terminate the lease contract or rental contract if a record is made in the land register with regards to it and if this record may not be eliminated from the land register due to the order.
9.6.A bailiff or a debtor shall not be liable for defects of the sold thing upon the sale of a thing in enforcement proceedings. This shall not preclude the possible liability of a bailiff or a debtor for unlawfully caused damage (article 103 of the Code of Enforcement Procedure).
10.1.By making the bid the Bidder shall confirm that he or she has acquainted and agreed with the present procedural rules and has acquainted with the property, with the materials describing it and is aware of the condition of the property and does not have any claims against haamer.net or the bailiff with respect to this.
10.2.In case if a participant of the auction turns out to be the winner of the auction and the auction is confirmed, he or she shall undertake to pay the price offered by him or her for the property and to cover all expenses, which may arise with transferring the ownership to the property.
10.3.The winner of the auction shall be a person who has made the highest bid, whose bid has not been exceeded by anyone within 75 seconds in the dynamic auction round.
10.4.The results of the auction shall be communicated to all participants of the auction in haamer.net immediately after the winner of the auction has become clear.
10.5.The results of the auction shall be confirmed immediately after the auction has taken place. If circumstances are found out, which prevent results from being confirmed, a notice shall be sent to all participants of the auction about the failure of the auction.
10.6.The bidding time shall be at least 14 days starting from opening of the auction.
10.6.1.Auctions shall be started with the starting price.
10.6.2.The bidder shall insert the amount, which shall be at least one step greater than the previous bid.
10.6.3.The step of a bid shall be specified separately with each auction in full euros.
10.6.4.If the bidder inserts the amount, which is greater than the minimal possible bid, automatic bidder shall be activated. Automatic bidder shall make the bids for the participant of the auction until the inserted amount, which the bidder had agreed to bid as the highest amount. Automatic bidder shall increase the bid only by one step. If several bidders make an automatic bid, the greatest of them shall remain, bidding the maximum over the lower bid by one step of the bid. Intermediate steps shall not be shown. If two bidders make automatic bids with equal amount, the first bidder by time shall be preferred.
10.6.5.The auction shall have a dynamic end. The dynamic end shall begin at the date and time previously specified.
10.6.6.If no new bid has arrived before the deadline within the period specified for the dynamic end (75 seconds), the auction shall end at the deadline specified in the terms and conditions. If a new bid has arrived before the deadline within the period specified for the dynamic end, the moment of arrival of such bid shall be deemed a new start of the period specified as the dynamic end, and the auction shall be prolonged.
10.6.7.Dynamic end shall last at least 40 seconds. If no new bid has been made within this period of time, the Customer who has made the highest bid shall be declared winner. The system of the auction shall notify the users with the notifications twice before the time for the bid expires: “First Time” and “Second Time”.
10.6.8.New automatic bids cannot be made in dynamic auction. Bids made in the preliminary round shall all be transferred to the dynamic round.
10.6.9.The results of the auction shall be seen to the participants immediately after the end of the auction under finished auctions (history of the auctions).
